Yulchon represented multinational corporation Oriental Brewery (“OB”) (AB InBev Group) and its CEO, in a criminal case concerning allegations of material customs duty evasion, and successfully prevented the detention of the CEO at the investigative stage by demonstrating that the alleged conduct is open to considerable legal interpretation under the Customs Act, resulting in the CEO being indicted without detention.


The case is significant as it is the first criminal case in which the transfer of goods imported using tariff rate quotas (TRQs) under a free trade agreement (FTA) domestically from one brewery company to another was deemed as the evasion of customs duties. The outcome of this case is likely to have a significant impact on domestic transactions of goods imported under the FTA TRQ system.
