Introduction

Chung Min Lee is a partner at Yulchon LLC who joined the firm in 2011 immediately after completing the Judicial Research and Training Institute program, and has since specialized exclusively in antitrust and competition law, handling every stage from advisory work and responses to Korea Fair Trade Commission investigations to administrative litigation. Mr. Lee prioritizes developing strategies with a clear view of how determinations made at the advisory and investigation stages may later be contested in litigation. In the field of intra-group transaction regulation, Mr. Lee has focused primarily on issues involving unfair assistance and unfair provision of benefits to specially related persons, obtaining non-violation decisions in numerous investigations. Mr. Lee has also obtained non-violation decisions and decisions not to initiate deliberation in investigations concerning alleged violations of cartel regulations, the Fair Transactions in Subcontracting Act, the Fair Transactions in Franchise Business Act, and the Act on Fair Labeling and Advertising. In addition, Mr. Lee has handled cartel-related administrative litigation, including a successful outcome in the cartel case involving 16 life insurance companies.In the field of business combinations, Mr. Lee has handled domestic and cross-border transactions in the semiconductor, software, and broadcasting/telecommunications sectors, including Synopsys's acquisition of Ansys, Broadcom's acquisition of VMware, and KT Skylife's acquisition of HCN. Mr. Lee has also provided implementation-stage advisory services, including representing a foreign airline in the traffic rights allocation process following the corrective measures imposed in connection with the Korean Air–Asiana Airlines merger. Mr. Lee has addressed competitive restriction issues arising from interoperability and de facto standards, and during his LL.M. program at Freie Universität Berlin, he wrote a thesis on de facto standard essential patents (de facto SEPs) and FRAND principles.In the field of broadcasting and telecommunications, based on his experience representing the Korea Media and Communications Commission in administrative litigation, Mr. Lee offers strategies that account for the perspectives of both regulators and regulated companies. He has handled cases involving abuse of market dominance by mobile carriers and violations of the Act on the Improvement of Mobile Device Distribution Structure, and in the market dominance abuse case involving the internet portal operator Daum Communications, he conducted a consent decree procedure during the early days of that system's introduction in Korea.In regulated industries, Mr. Lee has represented Korea Hydro & Nuclear Power since 2015, achieving numerous favorable outcomes, including complete victories, in litigation to revoke permits for the occupation and use of public waters in connection with nuclear power plants, lawsuits for damages arising from fishery losses, and environmental dispute mediation proceedings. Since 2020, he has also provided ongoing advisory services in connection with a large-scale mixed-use development project.Mr. Lee has further advised clients across a range of industries, including platform businesses, e-commerce, and semiconductor equipment, on the establishment of fair trade and subcontracting compliance systems.
